The Supplier may share and/or swap information, including Personal Information, with other Supplier related companies, affiliates, licensors and licensees (collectively referred to as “the TCS Entities”). The Supplier and the TCS Entities provide the Site so that customers are able to place online orders with participating The Cake Solution (“TCS”) stores located withinThe United Kingdom. Some TCS stores are independently operated and owned by Franchisees.
By using, browsing and/or accessing the pages or services in the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (‘T&C’s’). If you do not agree to these T&C’s, please do not use the Site. You also agree to provide us with your consent to receive any required notices (if any). You acknowledge that these T&C’s contain disclaimers and other provisions that limit the Suppliers or the TCS Entities’ liability to you. You further agree that you will not use the Site for any unlawful purpose. In the event that you do not wish to be bound by these T&C’s, please do not use browse or access the Site.
All orders are accepted and handled in accordance with the conditions below and the customer accepts these conditions by using the Site.
1. Governing law
The Supplier controls and operates this site on servers in a secure hosting facility. These T & C’s are governed by the laws of The United Kingdom. You and the Supplier agree to submit to the non-exclusive jurisdiction of the courts of The United Kingdom. You hereby waive any and all jurisdictional and venue defences that might otherwise be available to you.
2. Revisions to T & C’s
The Supplier may revise or amend these T&C’s at any time at our absolute discretion by posting revised terms. You agree that, in the event that any portion of these T&C’s is found to be unenforceable, the remainder of these T&C’s remain in full force and effect. Any revisions will be effective immediately and by your continued use of the Site, you agree to the T&C’S as amended. If you do not agree to the new posted T&C’s, you agree that your only remedy is to discontinue your use of the Site.
Whist The Supplier and the TCS Entities’ seek to make reasonable efforts to provide accurate and timely information about the various products and services offered by The Supplier on the Site, the Supplier cannot guarantee that the information provided is always up to date and correct or that the Site contains all the relevant information available.
3. Site content, ownership, and use restrictions
The material on the Site is protected by copyright under the laws of The United Kingdom and other countries through international treaties. Unless otherwise indicated and except for information directly from or links to third-party websites, all rights (including copyright) in all content, other material and compilations contained in, or used to create or support this site including text, graphics, logos, button icons, video images, audio clips and navigational and other software (collectively referred to as the Contents) are owned or controlled, and are reserved by the Supplier and the TCS Entities.
The display of the Contents is not intended to be a comprehensive compilation of all of the Suppliers worldwide proprietary ownership rights and the Supplier may own or control other proprietary rights in one or more countries outside of The United Kingdom. All rights not expressly granted are reserved.
4. Advertising & Links to Third Party Websites
This site may contain information from or hyperlinks and other pointers to internet websites operated by third parties. Such information or websites are not under the control of the Supplier and/or the TCS Entities nor is the Supplier or the TCS Entities responsible for the contents of any such information or website. The Supplier and/or the TCS Entities provide such information and hyperlinks to you as convenience only, and the inclusion of any link does not imply any endorsement of the linked website by the Supplier and/or the TCS Entities. You rely on such information or websites entirely at your own risk. You are referred to the relevant third party websites for all information regarding the third parties products and/or services. Third parties are solely responsible to you, subject to their conditions, for all issues relating to their website including information, goods, services, prices and the delivery of any goods or services you purchase on the third party website.
You further agree that the personal data you choose to give to unrelated third parties is not covered by the Supplier’s privacy policy and you are encouraged to review the privacy policy of any company or website before submitting your Personal Information. Some third parties may choose to share their personal data with the Supplier and/or the TCS Entities and you acknowledge any such sharing is governed by that third party company’s privacy policy.
5. Personal, non-commercial use
Permission is granted to display, copy, distribute, download, and print in hard copy portions of this Site solely for the proper and reasonable purposes of: a. Placing an order with the Supplier; or b. Using this site as a shopping resource, provided that you do not modify the site and that the Supplier retain all copyright and other proprietary notices contained in the Contents. You must not, without our prior written permission, exploit any of our site materials for commercial purposes or other purposes that are not expressly permitted under these T&C’s.
We encourage you to carefully read the Suppliers privacy policy (“the Privacy Policy”). You agree, and unless other consents or notices are required by law, that using, browsing and/or accessing the pages or services in the Site, that you will be bound by the terms of the Privacy Policy and to the use of such personal information and any submissions by the Supplier and/or the TCS Entities in accordance with the Privacy Policy.
You agree not to use the Site for any purpose that is unlawful or may be deemed as unlawful or prohibited by the T&C’s, or to cause damage on or through use of the Site. You warrant to the Supplier that none of your communications with or through the Site will violate any applicable, local, state, federal, provincial, national, or international laws and/or regulations or infringe upon the rights of any third party or contain libellous, defamatory, obscene or abusive material.
6. Prohibited conduct
You are not authorised, without the prior written permission of the Supplier and any other owner of rights in content that you access via the site, to reproduce, frame, download, store (in any medium), communicate, show or play in public, adapt, change, or create a derivative work from that content. No trademark (whether registered or otherwise) that is contained on this site or otherwise used by the Supplier may be used without our prior, specific, written permission or that of the trademark owner.
The content and material on the Site is provided for lawful purposes only and any other use or modification of the content and materials found on the Site violates the intellectual property rights of the Supplier and/or the TCS Entities. The Supplier and/or the TCS Entities retain complete and full title and intellectual property rights to all content and materials found on the Site. You may not sell, modify, reproduce, repost or convert any contents and/or materials on the Site in any manner inconsistent with these T&C’s.
7. Licence to use
You grant the Supplier a perpetual, irrevocable, non-exclusive, fully-paid, royalty-free licence to use any material, information, expression of ideas and ideas that you transmit to this site or otherwise provide to the Supplier from the time you authorise it to be sent without restrictions of any kind and without any payment or other consideration of any kind, or permission or notification, to you or any third party.
You agree that this license shall include, without limitation, the irrevocable right to reproduce, prepare derivative works, combine with other works, alter, translate, distribute copies, display, perform, and/or license the submission, and all rights therein, in the name of the Supplier and/or the TCS Entities or their designees throughout the world in perpetuity, in all media now or hereafter known or created. In addition, you warrant that any “moral rights” (if any) pertaining to any copyrighted materials have been waived.
8. User conduct
You must not upload, post, transmit or otherwise make available through this Site any material which: – violates or infringes the rights of others (including their privacy and intellectual property rights); – is unlawful, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene, profane or which may harass or cause distress or inconvenience to, or incite hatred of, any person; – encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law; restricts or inhibit the Supplier any other user from using the site; – affects the functionality or operation of the site or the Supplier servers or the functionality or operation of any user’s computer systems (e.g. by transmitting a computer virus or other harmful component, whether or not knowingly); or – breaches any standards, content requirements or codes promulgated by any relevant authority, including authorities that require the Supplier to take remedial action under any applicable industry code.
9. Indemnity
You agree to indemnify and will keep the Supplier indemnified against any claim, demand, injury, damage, loss, expense, cost or liability (whether direct or indirect) made against or suffered by the Supplier in connection with your use of this site, your breach of these T&C’s or your breach of any rights of third parties. Buying products from our website, Products may vary between the Supplier retail stores and those found on the Supplier website.

Becoming a member, what it means and managing your Membership.
New Members
New Members shall be “Members” for the purposes of these Terms and Conditions. New Members become Members when they have completed the registration process to join the Membership and been accepted as Members by us.
If you have not participated previously ‘joined our family’ to create an account with us to receive an electronic welcome voucher and birthday voucher, you can become a member by entering this URL in your web browser https://thecakesolution.co.uk/my-account/ and successfully completing the registration process (“New Member”). You are required to be over the age of 16 at the time of registration to become a New Member.
What Membership means
Your Membership can only be registered in the full name of an individual and an individual may only register one Membership.
All Members that have signed up to our website online to join our family: have provided a valid date of birth, name, address and phone number in your account information; and who have agreed to receive marketing communications from us, shall be emailed an electronic voucher for a single five pound off a full cake for joining our family (“Welcome Voucher”) and another electronic voucher for the same value before the date of their birthday each year that they are a Member (“Birthday Voucher”). You can use these Voucher on (subject to availability) any full cake purchase. You may also purchase two halves of cake to make a full one. Minimum spend applies.
Managing your Membership
You shall be able to manage Membership via your account. Managing your Membership includes being able to update your personal information but excludes the ability to change your Date of Birth.
Vouchers cannot be used on:
- Purchasing gift vouchers; and
- in conjunction with any discount, or privilege card whether issued by us or by any third party.
Redeeming Vouchers
Once you have received your voucher, you will be eligible to redeem your Voucher in participating stores (subject to availability).
Vouchers cannot be redeemed for cash and must be used for the specified item (s) on the appropriate Voucher. Vouchers can only be earned, held, and redeemed as set out in these Terms and Conditions. Any Vouchers obtained or used otherwise than in accordance with these Terms and Conditions will be invalid and cannot be redeemed.
Vouchers are personal to you and cannot be pooled with vouchers received by another Member and redeemed together for any Voucher.
To redeem a Voucher in-store, you will need to show us the date of the emailed voucher along with the voucher code at the point of purchase and must meet the minimum spend and product selection terms and conditions. Multiple Vouchers cannot be redeemed in the same transaction.
The Birthday Voucher will expire fourteen (14) days after the date that it was issued. Expired vouchers cannot be redeemed.
Vouchers cannot be redeemed in conjunction with other Vouchers, discounts, or promotions, unless the terms of the offer or promotion state otherwise and save as set out below.
Reward Vouchers cannot be:
- used more than once in any one transaction.
- used for purchases other than those stated on the Voucher.
- used in a manner which would entitle a member to a promotional offer. For example, if we had a buy one get one free offer on coffee, the use of the Voucher to purchase such a coffee would not entitle you to a second free coffee; or used in conjunction with any discount or privilege card whether issued by us or by any third party.
Expiry and Cancellation
Your Membership does not have an expiry date.
However, Vouchers are issued at our discretion, and we reserve the right to change, amend, cancel, or remove any Vouchers without notice, at any time.
Welcome and Birthday Vouchers have an expiry date, it is the Members responsibility to use any voucher with an expiry date, before the expiry date, expired vouchers cannot be redeemed after the expiry date and cannot be reinstated.
You may close your account at any time, please contact Customer Services on 0115 9851161 or via email to admin@thecakesolution.co.uk. If you cancel your Membership, you will lose the right to redeem any Vouchers that are unused at the time of cancellation, and you will not be sent any more voucher codes.
If you cancel your Membership, you may choose to re-join the Membership. When restarting your Membership, your previously-earned Vouchers will not continue to your new Membership and you will not be entitled to receive or redeem a welcome voucher for your ‘new’ account, welcome vouchers are only eligible to be issued one time per person.
If you are in breach of any of these Terms and Conditions, if we have reasonable grounds to suspect that you are engaged in fraudulent or other criminal activities relating to us or your participation in the Membership, or if you supply false or misleading information to us, fail to provide your full name, address and phone number in your account information, if we have reasonable grounds to suspect you have more than one account with us, we may:
- forfeit all Vouchers issued to you, and all associated accounts;
- suspend your right to receive Vouchers; and/or
- terminate your Membership/(s).
Orders Online
Ordering online allows Members to pre-order and pay for selected items from participating Cake Solution outlets and pick up their order at the relevant participating outlet. You may pre-order your items for collection and take-away.
To be able to order Online you must:
- be at least 16 years of age;
- follow the instructions on our website to choose the items you want to order from a participating outlet.
- follow the instructions on the ‘Order’ section of the website to input your credit/debit card details (please note that we do not currently accept non-UK credit/debit cards or American Express).
Once you have placed your order simply make yourself known to a member of staff at the collection point in the relevant participating outlet. You will be given the items that you have pre-ordered. We will use your name to help identify your order.
You do not have a right to cancel any order made through online ordering under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Once you have confirmed your order, your credit/debit card details will be processed by a third-party transactional supplier in accordance with the relevant Data Protection laws.
If you order from a participating outlet that is operated by one of our franchise partners, please note that: we are acting as an agent for that franchise partner with authority to conclude the sale transaction for the order on the website on behalf of the franchise partner, however (although we are acting as the franchise partner’s agent for the purposes of such transaction) the contract for such order shall be between you and the franchise partner;
- your order will be prepared by and the sale made by the franchise partner;
- the website will provide you with a collection receipt for your order via email;
- The Cake Solution is not acting in any way as your agent.
If you are a Member who uses the website, you will be able to redeem welcome and birthday vouchers against purchases made using our service. If you wish to redeem a Voucher you should select the appropriate payment option when purchasing your order.
If you want to request a refund for an item that you have paid for using online ordering then please contact customer services at admin@thecakesolution.co.uk and our customer services team shall determine whether you are entitled to a refund.
Orders for home delivery.
Welcome and Birthday vouchers are not redeemable online for home delivery customers.
Changes to your details
If you need to change any of the details you provided when you registered, please either:
- update your details through the website; or
- contact Customer Services by telephone on 0115 985 1161 or by email to Admin@thecakesolution.co.uk
Changes to your date of birth are not permitted.
Unauthorised access to your account
You should treat your Vouchers carefully. If someone else accesses your Membership, you may lose any points and/or vouchers you have earned.
You should immediately report any fraudulent or unauthorised use of your Membership to Customer Services on 0115 9851161 or via email to admin@thecakesolution.co.uk .
If someone makes unauthorised use of your Membership we may, at our sole discretion re-credit any Vouchers redeemed without your consent. Circumstances in which we may determine, in our sole discretion, that we will not transfer and/or re-credit points and/or Reward Vouchers include where we reasonably believe that the notified incident has been caused by your breach of these Terms and Conditions or if there are reasonable grounds for suspecting that you are or have been engaged in fraudulent or other unlawful conduct in relation to your Membership.

Compensation

Liability of The Cake Solution
If The Cake Solution fails to comply with these Terms and Conditions, it is responsible for loss or damage you suffer that is a foreseeable result of its breach or of its negligence. The Cake Solution is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of The Cake Solution breach or if it was contemplated by The Cake Solution and you at the time that you became a Member of the Membership and agreed to be bound by these Terms and Conditions.
The Cake Solution shall not be held liable for any loss or damage to you resulting directly or indirectly from any cause beyond our control, including but not limited to, failure of network services and failure of data processing systems.
Nothing in these Terms and Conditions excludes or limits our liability for: (1) death or personal injury caused by our negligence; (2) fraud or fraudulent misrepresentation; or (3) any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
To the extent permitted by law, our aggregate liability to you in respect of any loss or damage suffered and arising out of or in connection with these Terms and Conditions, whether in contract, tort (including negligence) or for breach of statutory duty, or in any other way, shall not exceed the amount of £5.
Your rights as a consumer
As a consumer you have legal rights in relation to goods that are not of a satisfactory quality or fit for purpose and services not carried out with reasonable care and skill. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards Office. Nothing in these Terms and Conditions will affect these legal rights.
Variation
We may make changes to these Terms and Conditions from time to time (if, for example, there is a change in the law that means we need to change these Terms). Please check these Terms and Conditions regularly to ensure that you understand the up-to-date terms that apply in relation to your Membership. For any significant changes to these Terms and Conditions that will materially impact you or if we choose to discontinue the Membership then we shall provide you with written notice.
Assignment
We may transfer the benefit of these Terms and Conditions to any other company in the same group of companies as The Cake Solution. If we assign the benefit of this Terms and Conditions, your rights will not be affected.
Governing law
These Terms and Conditions are governed by English law. This means that any dispute or claim arising out of or in connection with these Terms and Conditions and/or the Membership (including non-contractual disputes or claims), will be governed by the laws of England and Wales.
You can bring proceedings in respect of these Terms and Conditions in the English courts. However, as a consumer, if you live in Scotland or Wales and we direct our services to your country of residence then you can bring legal proceedings in respect of these Terms and Conditions in either the English courts or the courts of your country of residence.
If you are a consumer who is resident in Great Britain and we direct the Membership to (and/or pursue our commercial or professional activities in relation to the Membership in) the country in which you are resident, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms and Conditions affects your rights as a consumer to rely on such mandatory provisions of local law.

If you have not participated previously in our Loyalty Scheme, you can become a member by entering this URL in your web browser ldog.me/cake , or for iPhone users by scanning our QR code, or for Android users can use this link https://ldog.me/WalletPass and successfully completing the registration process (“New Member”). You are required to be over the age of 16 at the time of registration to become a New Member.
What Membership means
New Members shall be “Members” for the purposes of these Terms and Conditions. New Members become Members when they have completed the registration process to join the Membership and been accepted as Members by us. Your Membership can only be registered in the name of an individual and an individual may only register one Membership. Your Membership enables you to earn points. You will earn 1 point for every full pound spent. Once you have earned enough points for the rewards on offer, you will be notified via the wallet app if you have notifications switched on. You will be able to redeem Reward Vouchers in any participating store.
Managing your Membership
You shall be able to manage Membership via the Wallet App. Managing your Membership includes being able to update your personal information.
Points cannot be earned on:
Purchases using a Voucher; Purchasing gift vouchers; and in conjunction with any discount or privilege card whether issued by us or by any third party.
Redeeming Reward Vouchers
Once you have earned the number of points required for a reward, you will be eligible to redeem your Reward Voucher for that reward in participating stores.
You can check the number of points you have earned and the Reward Vouchers you have at any participating outlet or by checking the Wallet App.
Reward Vouchers cannot be redeemed for cash and must be used for the specified item (s) on the appropriate Reward Voucher. Points can only be earned, held and redeemed as set out in these Terms and Conditions. Any points or Reward Vouchers obtained or used otherwise than in accordance with these Terms and Conditions will be invalid and cannot be redeemed.

In order to redeem a Reward Voucher in-store, you will need to scan the QR Code at the point of purchase using the Wallet App and state that you would like to redeem your Reward Voucher. Multiple Reward Vouchers (provided they are personal to you) can be redeemed in the same transaction.
You may only redeem points against Reward Vouchers. Reward Vouchers can be redeemed in conjunction with other Reward Vouchers, discounts or promotions, unless the terms of the offer or promotion state otherwise and save as set out below.

We reserve the right to remove the Birthday reward without notice.

- we are acting as an agent for that franchise partner with authority to conclude the sale transaction for the order on the website on behalf of the franchise partner, however (although we are acting as the franchise partner’s agent for the purposes of such transaction) the contract for such order shall be between you and the franchise partner;
- your order will be prepared by and the sale made by the franchise partner;
- the website will provide you with a collection receipt for your order via email;
- The Cake Solution is not acting in any way as your agent.
If you are a Member who uses the website, you will be able to earn points against purchases made using our service. Points will be applied automatically on orders of Eligible Products. If you wish to redeem a Voucher you should select the appropriate payment option when purchasing your order.
If you want to request a refund for an item that you have paid for using online ordering then please contact customer services at admin@thecakesolution.co.uk and our customer services team shall determine whether you are entitled to a refund.
Changes to your details
If you need to change any of the details you provided when you registered, please either:
- update your details through the Wallet App; or
- contact Customer Services by telephone on 0115 985 1161 or by email to Admin@thecakesolution.co.uk
Unauthorised access to your account
You should treat your points and Reward Vouchers carefully. If someone else accesses your Membership through the Wallet App, you may lose any points and/or Reward Vouchers you have earned.
You should immediately report any loss or theft of your Card or any fraudulent or unauthorised use of your Membership to Customer Services on 0115 9851161 or via email to admin@thecakesolution.co.uk .
If someone makes unauthorised use of your Membership we may, at our sole discretion re-credit any points and/or Reward Vouchers redeemed without your consent to the Wallet App. Circumstances in which we may determine, in our sole discretion, that we will not transfer and/or re-credit points and/or Reward Vouchers include where we reasonably believe that the notified incident has been caused by your breach of these Terms and Conditions or if there are reasonable grounds for suspecting that you are or have been engaged in fraudulent or other unlawful conduct in relation to your Membership.

Compensation
Points and Reward Vouchers earned through using your Membership are not covered by any compensation scheme.

Liability of The Cake Solution
If The Cake Solution fails to comply with these Terms and Conditions, it is responsible for loss or damage you suffer that is a foreseeable result of its breach or of its negligence. The Cake Solution is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of The Cake Solution breach or if it was contemplated by The Cake Solution and you at the time that you became a Member of the Membership and agreed to be bound by these Terms and Conditions.
The Cake Solution shall not be held liable for any loss or damage to you resulting directly or indirectly from any cause beyond our control, including but not limited to, failure of network services and failure of data processing systems.
Nothing in these Terms and Conditions excludes or limits our liability for: (1) death or personal injury caused by our negligence; (2) fraud or fraudulent misrepresentation; or (3) any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
To the extent permitted by law, our aggregate liability to you in respect of any loss or damage suffered and arising out of or in connection with these Terms and Conditions, whether in contract, tort (including negligence) or for breach of statutory duty, or in any other way, shall not exceed the amount of £50.
Your rights as a consumer
As a consumer you have legal rights in relation to goods that are not of a satisfactory quality or fit for purpose and services not carried out with reasonable care and skill. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards Office. Nothing in these Terms and Conditions will affect these legal rights.
Variation
We may make changes to these Terms and Conditions from time to time (if, for example, there is a change in the law that means we need to change these Terms). Please check these Terms and Conditions regularly to ensure that you understand the up-to-date terms that apply in relation to your Membership.
For any significant changes to these Terms and Conditions that will materially impact you or if we choose to discontinue the Membership then we shall provide you with written notice.
Assignment
We may transfer the benefit of these Terms and Conditions to any other company in the same group of companies as The Cake Solution. If we assign the benefit of this Terms and Conditions, your rights will not be affected.
Governing law
These Terms and Conditions are governed by English law. This means that any dispute or claim arising out of or in connection with these Terms and Conditions and/or the Membership (including non-contractual disputes or claims), will be governed by the laws of England and Wales.
You can bring proceedings in respect of these Terms and Conditions in the English courts. However, as a consumer, if you live in Scotland or Wales and we direct our services to your country of residence then you can bring legal proceedings in respect of these Terms and Conditions in either the English courts or the courts of your country of residence.
If you are a consumer who is resident in Great Britain and we direct the Membership to (and/or pursue our commercial or professional activities in relation to the Membership in) the country in which you are resident, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms and Conditions affects your rights as a consumer to rely on such mandatory provisions of local law.
